The website www.maison-dome.com, the mobile site m.maison-dome.com as well as the Maison-Dôme  future mobile application (together and indifferently the "Site") are published by MAISON-DÔME, a simplified LIimited company, whose registered office is located at Ekerö, Stockholms Län, owned by Holitomic AB, whose intra-community VAT number is SE55 685 182 5101 ("MAISON-DÔME").

ARTICLE 1 - PURPOSE

These general terms and conditions of use (the "T&Cs") govern the use of the Site by any user, natural person, whoever they may be, who is at least sixteen years of age ("You").

In particular, they aim to define the conditions under which You can :

  • access and navigate on the Site;
  • publish comments (the "Customer Notices")
  • on the products sold on the Site, including via the Marketplace (the "Products");
  • on the sellers in the Marketplace ("Sellers").

By browsing the Site, You acknowledge that You have read and fully and unreservedly accept the T&CS.

MAISON-DÔME  reserves the right to modify the T&CS at any time. They will then be applicable as soon as they are put online. In this respect, we invite You to read the Terms and Conditions regularly.

ARTICLE 2 - ACCESS TO THE SITE

The Site is open to any Internet user or mobile user meeting the conditions set out in Article 1, provided they have an Internet connection.

However, the creation of a customer account is necessary if You wish to place an order on the Site. If necessary, please refer to the General Terms and Conditions of Sale and General Terms and Conditions Marketplace.

ARTICLE 3 - CUSTOMER ACCOUNT

Your customer account allows you to:

  • consult and update your details and means of payment ;
  • track your current orders and consult the history of your last orders and refunds over the last six months;
  • return an item and get a refund;
  • consult the promotional offers that You benefit from;
  • Create a list of your favourite products;
  • configure your options for sending out advertising campaigns.

To create your customer account, You must fill in a registration form including your contact details (title, surname, first name, postal and email address, telephone, date of birth) and create your personal password. You will then receive an email confirming the creation of your customer account and containing all your customer data.

By proceeding with the creation of your customer account, You undertake to provide accurate, complete and up-to-date information.

It is specified that your identifiers (email address or customer number and password) are under your full responsibility. It is therefore your responsibility to ensure the confidentiality of this information, and to report any fraud or hacking to MAISON-DÔME 's customer service department as soon as possible.

You also have the possibility to create your customer account by connecting to MAISON-DÔME  through a simplified procedure via your Facebook account (Facebook Connect).

To delete your customer account, You are invited to contact MAISON-DÔME 's customer service department in accordance with the provisions "Your access, modification and deletion rights" in the "Personal Data" tab of the Site. It is specified that MAISON-DÔME may also be required to delete a customer account that has no current order due to regulations related to personal data.

ARTICLE 4 - CUSTOMER OPINIONS

4.1 General information

MAISON-DÔME has set up a system for collecting and publishing Customer Notices on the Site, allowing in particular :

  • to help other users to compare and choose the best Product or the best Seller;
  • to adapt its offer and improve the quality of the Products or the selection of Sellers.

Each Customer Review also includes a rating between one (1) and five (5) stars. One

4.1 General information

MAISON DÔME has set up a system for collecting and publishing Customer Notices on the Site, allowing in particular :

  • to help other users to compare and choose the best Product or the best Seller;
  • to adapt its offer and improve the quality of the Products or the selection of Sellers.

Each Customer Review also includes a rating between one (1) and five (5) stars. An overall mark is then attributed to the Product or Seller concerned, corresponding to the arithmetic average of all online Customer Reviews relating to the Product or Seller concerned.

These Customer Reviews are presented, by default, in chronological order. You can also find more information about Customer Notices on https://www.laredoute.fr/avis-clients-authentiques.aspx.

4.2 Prerequisite

Only Customers who have placed an order are likely to give their opinion on the Product ordered or on the Seller selected.

The submission of Customer Opinions is not subject to compensation.

As such, MAISON DÔME will send You an email following the delivery of your Product in which it will invite You to leave your Customer Opinion on the Products purchased within the limit of five (5) Products, and/or on the Sellers concerned. If You wish to give Your Customer Notice, You must click on the link in the email. You can also leave your Customer Notice from your customer area available on the Site. You will then be automatically redirected to a form allowing you to comment on the Product or the Seller selected. You will then be able to enter the content of your Customer Review and rate the Product (general rating, quality/price ratio, style, material, etc.) or the Seller (general rating, quality of the product sheet, compliance with delivery times, customer service satisfaction, etc.).

4.3 Identification of the author of the Customer Opinion

In order to be able to publish a Customer Notice, You must necessarily enter a pseudonym with a minimum of four (4) characters and avoid using your last name.

Your real identity and more generally, any personal data concerning you must never be communicated via your Customer Notices. Failing this, You understand that your personal data will be published publicly on the Site and accessible to all users. MAISON DÔME cannot be held responsible for such distribution.

4.4 Access to Customer Notices

 

A Customer Notification will be posted online no later than five (5) business days after you submit your Customer Notification via the form, subject to the moderation provisions.

Customer Notices remain accessible on the Site as long as :

  • the Product concerned is accessible on the Site, provided that there is no change in the supplier or the main characteristics of the Product making the Customer Notice obsolete;
  • the Seller concerned is referenced by MAISON DÔME on the Marketplace.

 

By publishing a Customer Notice, You understand and accept that the latter (i) is publicly displayed on the Site and accessible to any user, and possibly to internet users outside the Site via search engine referencing and (ii) is used by MAISON DÔME for the purpose of promoting, by any means and on any medium, the Products, the Sellers, the Customer Notice system and more generally the Site (sending newsletters, etc.).

ARTICLE 5 - COMMITMENTS OF THE AUTHOR OF THE CUSTOMER NOTICE

Any user can find out, thanks to the Customer Notices, the rating given by other users in relation to a Product (qualities, defects) or a Seller (delivery, customer service, etc.). In this respect, You undertake to :

  • post a Customer Notice that is useful in the sense that it should help other users to compare and choose the best Product or the best Seller or, at MAISON DÔME, to adapt its offer and improve the quality of the Products or the selection of the Sellers.
  • to deliver non misleading and relevant information i.e. :
  • relating to the Product itself (its qualities, its essential characteristics) and not to the services related to the Product to which the Customer Notice refers such as delivery, payment, return. We invite you, if necessary, to contact MAISON DÔME's after-sales service (WHatsapp 0044 7 537169279) every day from 8am to 8pm;
  • relating to the Seller itself and its services and not to the qualities of the Product sold by the Seller to which the Customer Notice refers;
  • and more generally, not unrelated to the Product or Seller referred to in the Customer Notice.
  • not to use language that is incomprehensible, unintelligible, and/or without any meaning or to publish a Customer Notice in a foreign language.

In addition, the content of the Customer Notice must not :

  • be contrary to applicable laws and regulations

In addition, the content of the Customer Notice must not :

  • be contrary to the laws and regulations in force;
  • be contrary to public order and morality, including, without limitation, violent, hateful, abusive, denigrating, defamatory, vulgar, etc...
  • infringe an intellectual or industrial property right, personality right or any other right held by a third party;
  • be inappropriate in relation to another Customer Notice or its author;
  • contain personal and/or sensitive data;
  • contain hypertext links;
  • be of an advertising nature or mention another company or prize;
  • contain computer viruses, spyware, malicious software...

ARTICLE 6 - MODERATION OF CUSTOMER OPINIONS

  • MAISON DÔMEcarries out a moderation a priori. This means that Customer Notices are first evaluated and then put online on the Site. This evaluation is carried out by an external service provider, in the capacity of Maison Dôme´s moderator.
  • In this capacity, Maison Dôme moderator reserves the right to reject, at its discretion, any Customer Notice that specifically contravenes the provisions of article 5 and more generally these Terms and Conditions and/or French and European law.
  • Moderation is carried out indiscriminately on all Customer Notices, regardless of their content, and no later than five (5) working days following the submission of the Customer Notice.
  • You will then be informed by email of the reasoned decision to publish or not to publish your Customer Notice by the MAISON DÔMEmoderator.
  • In the event that your Customer Notice is not published, You will have the opportunity to draft a new Customer Notice on the Product or Seller concerned, if necessary, in accordance with these General Terms and Conditions.
  • Once the Customer Notice has been published, You will not be able to modify it.
  • It is specified that MAISON DÔME has a right of reply to the Customer Notices published. MAISON DÔME may also contact you following the publication of a Customer Notice as part of its customer management follow-up.

ARTICLE 7 - REPORTING ABUSE

You may at any time notify us of a Customer Notice that infringes your rights and/or contravenes the TOS by contacting the moderator via the "Report" link under the relevant Customer Notice. If necessary, the Customer Notice will be temporarily unpublished from the Site until it has been further checked by the moderator.

ARTICLE 8 - PERSONAL DATA

The personal data collected on the Site will be subject to computer processing. You are invited to refer to the "Personal Data" tab of the Site to obtain all the information relating to this point.

All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. Similarly, the trademarks, logos, designs and models appearing on the Site are the exclusive property of MAISON DÔME. Under no circumstances can their disclosure be interpreted as granting a licence or a right to use any of the said trademarks and distinctive elements protected by copyright. They cannot therefore be used under penalty of counterfeiting.

Thus, none of the documents from the Site may be copied, reproduced, republished, downloaded, posted, transmitted, or distributed in any way whatsoever.

 

However, it is possible to download a copy of the documents onto a computer for your personal use and solely for non-commercial purposes, provided that you do not modify the information contained and that you keep intact all copyright and other property notices. Modification of these documents or their use for any other purpose constitutes an infringement of Maison Dôme´s intellectual property rights.

If You have a personal website and wish to place, for personal use, on your website a simple link directly to the home page of the Site, You must request authorisation from MAISON DÔME. This will in no way constitute an implicit affiliation agreement.

On the other hand, any hypertext link to the Site using the framing or in-line linking technique is strictly forbidden. In all cases, any link must be removed on simple request from MAISON DÔME.

ARTICLE 10 - LIABILITY

MAISON DÔME undertakes to ensure the proper functioning of the Site, however it cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a breakdown in service, external intrusion or the presence of computer viruses.

MAISON DÔME  will make its best efforts to prevent Customer Notices that are contrary to legal or regulatory provisions and more generally to these Terms and Conditions from being accessible on the Site. The Customer Notices are published under the full and sole responsibility of their authors; MAISON DÔME cannot be held responsible for content of which it is not the author.

ARTICLE 11 - DISPUTES

The T&Cs are subject to Swedish  law. The competent court in the event of a dispute will be that of the defendant's place of residence.

The Site complies with French law, and under no circumstances does MAISON DÔME give any guarantee of compliance with local legislation that would be applicable to You, if You access the Site from other countries.
